Terms of Service

By accessing our website, requesting a quote, or hiring us for painting or related services, you agree to these Terms of Service.

1) Services

• We provide residential and commercial painting and related prep/repair services as listed on our site or in a written estimate.
• Work begins upon written approval of an estimate, proposal, or service agreement (“Contract”).

2) Estimates, Scope & Changes

• Estimates are based on information available at the time. Hidden or unforeseen conditions (e.g., rot, moisture, lead paint) may require a change order.
• Any scope change will be documented and priced before we proceed.

3) Deposits & Payments

• Deposits (if required) and payment schedule will appear on your invoice/Contract.
• Final payment is due upon substantial completion unless otherwise stated.
• Late balances may incur reasonable late fees or collection costs as permitted by law.

4) Customer Responsibilities

• Provide clear access to work areas and disclose hazards (e.g., asbestos, mold, lead-based paint).
• Remove or protect personal items; we will mask/protect work areas using industry-standard practices.

5) Scheduling, Delays & Site Conditions

• We aim to meet agreed timelines; weather, supply issues, or safety concerns may cause delays.
• We may pause work if conditions are unsafe or unsuitable (e.g., moisture, temperature, ventilation).

6) Materials & Colors

• We use quality, reputable products. Brand or product substitutions of equal or higher quality may occur if needed.
• Color approval is the customer’s responsibility. We recommend samples/mockups before full application.

7) Warranty (Workmanship)

We provide a limited workmanship warranty as stated in your Contract (commonly 1–3 years depending on scope and substrate). Warranty excludes:

• Normal wear and tear, fading due to sun/UV exposure, moisture intrusion, structural movement, or substrate failure.
• Damage from improper maintenance, impact, abrasion, or chemicals not compatible with the finish.

8) Website Use & Intellectual Property

• All site content (logos, text, images) is owned by Locos Painting or licensed to us. Do not copy or reuse without permission.
• Website content is informational only and may change without notice.

9) Disclaimers & Limitation of Liability

• To the fullest extent permitted by law, we disclaim implied warranties not expressly stated in your Contract.
• Our total liability for any claim is limited to the amount you paid us for the specific services at issue.
• We are not liable for indirect, incidental, special, or consequential damages.

10) Indemnification

You agree to indemnify and hold us harmless from claims arising from your breach of these Terms or misuse of our services, except to the extent caused by our negligence or willful misconduct.

11) Governing Law & Disputes

• These Terms are governed by the laws of the state where services are performed.
• If a dispute arises, parties will first attempt good-faith resolution. If unresolved, the dispute may be brought in the state/local courts with jurisdiction where the work occurred.

12) Changes to These Terms

We may update these Terms from time to time. The “Last updated” date will reflect the current version.
